General Terms and Conditions of Sale

1. Scope of application

These general terms and conditions of sale apply to all sales concluded on the www.stradivarius-editions.com website, subject to the specific conditions indicated in the product presentation.
The present conditions may be modified at any time without prior notice by the site administrator..

2. Product description

The www.stradivarius-editions.com website offers intellectual works for sale in digital format (scores, images, videos, recordings, etc.).
These digital files are intended to be downloaded for reading on electronic terminals or printed on paper by the purchaser.
They are protected by French and international copyright laws. In the absence of a license specifying other conditions of use, these downloaded files are reserved for the exclusive use of the purchaser.
They may not be resold, rented or transmitted free of charge beyond the family circle and the legitimate needs of private use; any representation or reproduction of these files, in whole or in part, outside the cases provided for in article L122-5 of the French Intellectual Property Code, is strictly forbidden and would expose the holder to legal action.
In order to protect the rights of authors without restricting the use of downloaded files by those who have legitimately acquired them, all items purchased on this site are personalized with data originating from the customer (surname, first name, e-mail address), via a double digital marking applied dynamically to each page or within the digital file.

3. Orders

All orders are placed exclusively via the www.stradivarius-editions.com website. Payment is made when the order is placed.
The customer must be at least 18 years old and have legal capacity or parental authorization to place an order.
Clicking on the "Buy" button on the screen summarizing the order, and explicitly accepting the present general terms and conditions of sale via a dialog box, constitutes an electronic signature expressly certifying the customer's unreserved consent to the present general terms and conditions of sale and to the special terms and conditions (in particular the unit price) specific to each file purchased. The customer hereby waives the right to invoke any contradictory document, in particular his own general terms and conditions of purchase.
The customer may abandon his order until payment has been confirmed.
Any order with a fraud risk profile may be blocked by the administrator at the payment stage.

4. Availability of items

Items are normally available to customers 24 hours a day, 7 days a week, all year round. However, the administrator of this site reserves the right to temporarily close access without prior notice.
It cannot be held responsible for technical problems beyond its control, such as connection problems due to Internet service providers or computer problems due to the customer's hardware or software.

5. Prices

Product prices are deemed net including all taxes.
VAT not applicable, article 293 B of the French General Tax Code.

6. Payment

The price is payable in full in a single instalment when the order is placed.
Payment is made by credit card via the Stripe payment platform. The bank transaction is carried out at the time the order is placed.
As soon as the payment method used by the credit card purchaser has been validated, the order is confirmed and can no longer be cancelled or reimbursed.

7. Delivery

Digital works purchased on this site are delivered by download.
A few minutes after payment of the order, an e-mail is sent to the customer with one or more single-use download links enabling the works to be loaded onto the customer's computer.

8. Warranty, return and refund

Purchases of digital media are firm and final. They cannot give rise to any exchange, refund or right of withdrawal.

9. Protection of your personal data - GDPR

Some of the information requested from our customers is necessary for the proper processing of orders, and some is useful for getting to know our customers better and improving the services offered on this site.

The products offered comply with current French legislation.
www.stradivarius-editions.com cannot be held responsible for any failure to comply with the legislation of the country where the product is shipped or downloaded. It is the purchaser's responsibility to check with the relevant local authorities regarding the use of the products ordered.

11. Applicable law

These general terms and conditions of sale are governed by French law.
Any dispute shall be brought before the competent courts for the geographical area in which the registered office of the administrator of the present site is located.
